These Terms of Use ("Terms") govern your use of goodpitball.com (the "Site"), operated by GoodPitBall ("GoodPitBall", "we", "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Wholesale only

GoodPitBall is a wholesale supplier to commercial buyers. Products are not sold to consumers through the Site, and no purchase can be completed on the Site. Wholesale sales are handled by Global Environmental Solutions (GES).

Pricing and product information

Prices, minimum order quantities, specifications and other information on the Site are provided for general information and may change without notice. They are not an offer to sell. Submitting a wholesale pricing request does not create an order or a contract.

Orders are governed only by the formal quote and the terms of sale provided by GES, including pricing, freight, payment, delivery, warranty and returns. If anything on the Site conflicts with a formal quote or terms of sale, the quote and terms of sale control.

Estimates produced by the Site's order quantity calculator are approximate and are provided for planning purposes only.

Acceptable use

You agree not to misuse the Site, including by submitting false or misleading requests, sending spam, attempting to gain unauthorized access to the Site or its admin area, interfering with its operation, or scraping it in a way that places an unreasonable load on our systems.

Intellectual property

The Site, including its text, graphics, logos and design, is owned by GoodPitBall or its licensors and is protected by intellectual property laws. You may view and print pages for your own business purposes, such as evaluating a purchase, but may not otherwise copy, modify or distribute Site content without our written permission. "GoodPitBall" and the GoodPitBall logo are trademarks of GoodPitBall.

The Site links to third-party websites, including the GES website. We are not responsible for the content, policies or practices of those websites.

Disclaimer

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties regarding the Site, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. Product warranties, if any, are provided only in the terms of sale.

To the fullest extent permitted by law, GoodPitBall will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenue, arising from your use of the Site.
